Terms of Use

Effective date: February 20, 2026

By using this platform (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

1. What This Is

This Service helps you store, organize, and (if you choose) share photos, notes, and other content related to the things that matter to you. We built it to preserve memories and projects, and we take that seriously.

2. The Real World Clause (Storage & Guarantees)

We do our best to build systems that are stable, secure, and designed to last. We aim for long-term storage, accuracy, and strong security.

But we do not live in a perfect world. Servers can fail. Software may contain bugs. Infrastructure providers can have outages. And while we work hard to prevent problems, no online service can promise perfection.

Because of that, we do not guarantee:

  • Permanent storage or that your content will exist forever
  • Zero data loss or zero corruption
  • Perfect uptime or uninterrupted access
  • Perfect accuracy (including automated/AI results)
  • Immunity from security incidents or unauthorized access

If something truly cannot be lost, you should keep your own backups. That's exactly why we built an export function—use it occasionally, just in case.

To the maximum extent permitted by law, we are not responsible for lost or inaccessible content, corrupted files, downtime, or any resulting losses (including sentimental or emotional value).

3. Sharing Content (If You Choose To Use It)

The Service may include features that let you share content with other people (for example, sharing an item, project, album, link, or category), if and when you choose to use those features.

If you share something, you are responsible for who you share it with. We cannot control what someone else does after you share content with them. They may download it, copy it, screenshot it, forward it, or redistribute it.

To the maximum extent permitted by law, we are not responsible for:

  • Anyone saving, copying, redistributing, or misusing content you shared
  • Someone you trusted violating your trust
  • Content reaching people you did not intend to see it

If you share something, assume it may travel beyond your intended audience.

4. Zero Tolerance for Abuse

This Service is for memories and organization—not for abusive, exploitative, or illegal content. We have a strict zero-tolerance policy for the following:

  • Pornography or sexually explicit content
  • Any sexual content involving minors (zero tolerance)
  • Exploitation, trafficking, or abuse
  • Non-consensual intimate imagery
  • Hate speech, harassment, or threats of violence
  • Content that promotes or facilitates illegal activity
  • Terrorist content or criminal facilitation

One-Strike Policy: Serious violations are a one-strike policy: if you upload content that violates this section, we may immediately and permanently terminate your account, remove or restrict access, and delete content associated with the violation. No warnings. No negotiation.

5. AI Review & Enforcement

Uploads may be automatically scanned and reviewed by AI systems to help detect prohibited content and platform abuse. AI is not perfect and can make mistakes.

We reserve the right to flag content, restrict features, remove content, suspend accounts, or terminate accounts if we believe there is a violation of these Terms or a risk to users, the platform, or the public.

6. Reporting Illegal Content

If we detect content that appears to involve serious criminal activity—especially exploitation of minors—we may:

  • Preserve content and relevant metadata
  • Log IP addresses, device identifiers, and access records
  • Report the matter to appropriate Canadian and/or international law enforcement authorities
  • Cooperate fully with investigations

This may happen without notice to you.

7. Accounts, Termination & No Compensation

We may suspend or terminate your account if you violate these Terms, if we suspect abuse or illegal activity, or if we believe there is a security, legal, or safety risk.

If your account is suspended or terminated, access may be revoked immediately and content may be deleted. No compensation or refunds will be provided (to the maximum extent permitted by law).

8. No Warranties

The Service is provided on an "as is" and "as available" basis. We do not make warranties of any kind, including warranties of uninterrupted availability, error-free operation, or perfect security.

9. Limitation of Liability

To the maximum extent permitted under Ontario and Canadian law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses related to data loss, emotional distress, lost profits, business interruption, or third-party misuse of content you shared.

If you paid for the Service, our total liability for any claim will not exceed the amount you paid in the previous 12 months. If you use the Service for free, our maximum liability is $0.

10. Your Content & Your Responsibility

You are responsible for the content you upload and share. By uploading content, you represent and warrant that:

  • You have the legal right to upload and share it
  • It does not violate applicable laws
  • It does not infringe the rights of others
  • It complies with these Terms

11. Indemnity

If someone makes a claim against us because of your content, your use of the Service, or your violation of these Terms, you agree (to the maximum extent permitted by law) to indemnify and hold us harmless from losses, liabilities, damages, and reasonable legal fees.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Ontario, Canada.

13. Changes to These Terms

We may update these Terms from time to time. If we do, we'll update the Effective Date above. By continuing to use the Service after changes take effect, you agree to the updated Terms.
